SOFTWARE AS A SERVICE AGREEMENT

This Software as a Service Agreement ("Agreement") is entered into between Mod Depot ("Company", "we", "our", or "us") and the entity or individual agreeing to these terms ("Customer", "you", "your"). By using our services, you agree to comply with and be bound by this Agreement.
1. SERVICES PROVIDED
Mod Depot provides a cloud-based service that enables Customers to create a customized, branded modpack with their own styles, colors, and a selection of Mods provided exclusively by Mod Depot. This service facilitates the streamlined management and delivery of modifications for World of Tanks to end users.
2. LICENSE GRANT
We grant you a non-exclusive, non-transferable, revocable license to use our service in accordance with this Agreement. You may not sublicense, modify, or reverse-engineer the service.
3. FEES AND PAYMENT
- The Service is provided free of charge to end users.
- Business Customers are required to pay a commission fee as outlined in the agreed partnership terms.
- Payment terms, if applicable, will be outlined in a separate agreement or invoice.
4. CUSTOMER RESPONSIBILITIES
Customers using Mod Depot services are required to adhere to the following responsibilities:
- Timely Payments: Customers must pay all applicable fees and commissions on time, as outlined in the agreed partnership terms.
- Compliance with Laws and Regulations: The visual design, naming conventions, and language used in the customized modpacks must not violate the laws of the Customer’s country of operation, the laws of Poland, or the rules set by Wargaming.
- Respect for Others: Customizations made to the modpacks must not contain any content that is defamatory, discriminatory, or otherwise offensive. Customers must ensure that their modifications do not degrade or infringe upon the dignity and rights of others.
- Adherence to Platform Guidelines: Customers must follow all applicable guidelines and policies established by Mod Depot to ensure a consistent and safe user experience.
5. INTELLECTUAL PROPERTY RIGHTS
- Mod Depot does not claim ownership over the Mods hosted on its platform.
- The Company retains all rights to its own technology, trademarks, and branding.
6. DATA PRIVACY AND SECURITY
- We are committed to protecting your data. Please refer to our Privacy Policy for detailed information on our data handling practices.
- We implement industry-standard security measures, including encryption and secure access protocols, to protect your data from unauthorized access, alteration, disclosure, or destruction.
- Customers are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
7. SERVICE AVAILABILITY AND SUPPORT
- We strive to ensure uninterrupted service but do not guarantee 100% uptime.
- Support requests can be made via support@mod-depot.cloud.
8. LIMITATION OF LIABILITY
- The Company is not liable for any damages resulting from the use or inability to use the service.
- We are not responsible for any issues arising from third-party Mods.
9. TERMINATION
- Either party may terminate this Agreement with prior notice.
- Breach of this Agreement may result in immediate termination of service.
10. GOVERNING LAW
This Agreement is governed by the laws of Poland.
